1. ABOUT THIS WEBSITE

This website showcases original artwork, illustrations, and video editing services. We offer original artworks, prints, digital products, and commission-based work for sale, depending on availability.

2. PRICING & PAYMENT

  • All prices are shown in South African Rand (ZAR) unless otherwise stated.

  • We reserve the right to update pricing at any time, but orders will always be charged at the price shown at checkout.

  • Payment must be received in full before your order is processed and shipped.

  • Accepted Payment Methods: Payments are processed securely via PayFast and PayPal.

  • Colour Variance: Please note that while we strive for accuracy, actual colours depend on your monitor/screen settings. We cannot guarantee that your monitor's display will be a 100% match of the physical artwork.

3. ORDER CONFIRMATION

Once payment is successful, you will receive an email confirmation. If you do not receive confirmation within 24 hours, please contact us.

4. AVAILABILITY

All original artworks are sold on a first-come-first-served basis. If an item sells out or becomes unavailable after purchase, we will contact you to offer a full refund or an alternative product of equal value.

5. DELIVERY & TRACKING (SOUTH AFRICA)

  • Shipping Fee: We charge a flat-rate shipping fee of R200 for nationwide domestic orders.

  • Processing Time: Orders for existing works are typically processed within 2–5 business days.

  • Tracking: All shipments include a tracking number, shared once the order has been dispatched.

  • Oil Painting Drying Time: Original oil paintings may require additional drying time before they can be safely packaged. We will communicate any expected delays to ensure the safety of the work.

  • International Shipping: Available by request. Customers are responsible for any international customs duties or import taxes.

6. DAMAGE IN TRANSIT

We take care to package artwork securely. If your item arrives damaged, you must:

  1. Email us within 48 hours of delivery.

  2. Include clear photos of the damage and the original packaging. We will assess the situation and arrange a replacement or refund if applicable.

7. RETURNS & REFUNDS (CPA NOTICE)

We comply with the South African Consumer Protection Act (CPA).

  • Change of Mind: You may request a return within 7 days of delivery. The item must be unused and in original packaging. Return courier costs are for the customer.

  • Faulty or Damaged Goods: If an item is faulty or damaged (not due to misuse), you may request a return, repair, replacement, or refund in line with the CPA.

  • Digital Products: If any digital downloads are offered, these are non-refundable once delivered.

  • Custom / Commissioned Work: Custom commission work and video editing services are non-refundable once the project has been approved and work has commenced.

8. COMMISSIONS & VIDEO PROJECTS

Commission requests are handled via the Contact/Commissions form or email.

  • To request a commission, please include: Size, preferred medium, deadline, reference images, and budget range.

  • Commission work may require a deposit before work begins and final payment before delivery.

9. COPYRIGHT & OWNERSHIP

  • All artwork and digital content remain the intellectual property of Deena Foulkes.

  • Purchasing an artwork does not transfer the right to reproduce, copy, resell, or use the artwork commercially.

  • You may not use any content from this website without written permission.

10. PRIVACY & POPIA

We respect your privacy and comply with South Africa’s POPIA.

  • Information Collection: We collect your name, email, and address solely to fulfill orders.

  • Security: This website uses SSL (Secure Socket Layer) encryption to ensure all submitted data is encrypted and securely transmitted.

These Terms & Conditions are governed by the laws of the Republic of South Africa.
